Texas Data Center Pause Won't Stop Cortex 2 at Giga Texas

Texas Governor Greg Abbott's sweeping directive to pause new data center construction approvals is sending shockwaves through the state's energy sector — but Tesla's Cortex 2 AI supercomputer facility at Giga Texas is effectively insulated from it. The facility is already deep into construction and nearing full operation, placing it outside the scope of the new policy's approval freeze.

What Abbott's Directive Actually Does

On August 3, 2026, Governor Abbott directed the Public Utility Commission of Texas (PUCT) and the Electric Reliability Council of Texas (ERCOT) to halt approvals for any pending data center interconnection requests. The directive requires projects in ERCOT's queue to submit detailed disclosures — reliance on tax incentives, projected electricity and water consumption, on-site generation capacity, community impact measures, and ownership structure — before any further approvals are granted. Projects that fail to comply will be denied grid connection outright.

The policy also forced ERCOT to postpone its "Batch Zero" system-wide review of large-load projects, originally scheduled for August 7, 2026. ERCOT will now seek a good-cause exception at the PUCT meeting on August 20, 2026. The directive follows earlier expectations Abbott set on June 10, 2026, which had already prompted at least one East Texas data center project — Diode — to withdraw on July 23, 2026 after failing to meet the outlined standards.

The underlying concern is straightforward: Texas' grid is under mounting strain from a surge of large AI and data center projects, and state officials want visibility into what's coming before approving more load.

Why Cortex 2 Is in a Different Position

The key distinction is timing. Abbott's pause targets projects still seeking interconnection approval — not facilities already under construction with grid connections in progress or established. Cortex 2 cleared that hurdle well before the August 3 directive landed.

According to aerial observer Joe Tegtmeyer, who has closely tracked the Giga Texas campus, Cortex 2 is "largely unaffected" by the new policy precisely because it is already under construction and advancing toward full operation. The facility's first 250 MW phase went live in April 2026, and as of May 2026 it was operating partially, with permits showing Data Hall 5 nearing completion and plans to roughly double the installed Megapack count from approximately 130 to 250 units.

Tesla's own Q2 2026 earnings report confirmed the momentum: the company stated that its onsite AI compute capacity in Texas more than doubled in megawatts during the first half of 2026, driven primarily by Cortex 2. That kind of operational progress makes it a very different animal from a project sitting in ERCOT's interconnection queue waiting for a green light.

The Broader Context for Texas AI Infrastructure

Abbott's directive reflects a real tension building across Texas. The state has attracted an enormous concentration of AI compute investment — from hyperscalers to Tesla — largely because of its deregulated energy market, available land, and business-friendly incentives. But that same wave of investment is now straining ERCOT's ability to plan and manage grid load. The pause is an attempt to get ahead of a problem before it becomes a reliability crisis.

For Tesla specifically, Cortex 2 is not a speculative future project — it is the operational backbone of the company's AI training infrastructure, directly supporting FSD development, Optimus robot training, and Dojo workloads. Getting it fully online is a strategic priority, and the Texas policy timeline appears to work in Tesla's favor: the facility was far enough along that it avoided the approval bottleneck entirely.

Whether future expansions beyond the current Cortex 2 buildout would face scrutiny under Abbott's new framework is an open question. For now, though, the facility that matters most to Tesla's near-term AI roadmap continues on schedule.
